Supreme Court on expiry of claims for damages arising from design contracts
Under the guise of the coronavirus crisis, the Civil Chamber of the Supreme Court issued an important decision on 25 March 2020 regarding the expiration of claims for damages arising from building design contracts. In that case (c matter No. 2-16-14644), the parties disputed whether a limitation period of three or five years applies to the expiry of the requirements arising from the building design contract due to a lack of construction work. It was also debated when the expiry of the requirement arising from the design contract would begin. The design contract is also an employment contract by nature, and if an error is made in the design, it appears as a defect in the structure. Consequently, design contracts must be subject to a five-year limitation period under this Supreme Court position. Read the full article

Andres Männart tries to avoid prison
The court did not hear at all whether Männart was a reasonable person to serve a replacement sentence, said Raul Ainla, a barrister in Andres Männart's defense, who said Männart is not a dangerous recidivist for society, for example.
